VTL 319. 1a Driving without Insurance

Driving without insurance is one of the most serious traffic infractions under the NYS VTL. If you are convicted of driving without insurance in violation of VTL 319.1a, your license will be revoked for 1 year in addition to a fine of at least $100, a surcharge of at least $80 and a civil penalty imposed by the DMV of $750.
 
The ultimate resolution of a ticket for driving without insurance depends on a number of factors including whether there was an accident at the time the ticket was given, who actually owns of the vehicle, whether other tickets were given out at the same time, the court that the ticket is returnable to, and whether you are actually able to show proof that the vehicle was insured at the time of the incident, or if there was a lapse, the number of days the insurance had lapsed for.
 
Unless you are able to show proof that the vehicle was insured at the time of the stop, a ticket for no insurance is not the type of charge motorist should handle by themselves. If you have received a ticket for no insurance you really should consult with an attorney.
