Nassau County Tickets

As a Nassau County traffic lawyer, I have handled thousands of traffic tickets in Nassau County. Misdemeanor tickets, such as driving with a suspended license, reckless driving, and revoked registration are usually returnable to the Nassau County First District Court, 99 Main Street, Hempstead, NY. Sometimes, however, some misdemeanor charges may be heard at the various Village and Justice Courts throughout Nassau County. Driving while intoxicated cases are generally returnable to the First District Court in Hempstead, or to the County Court in Mineola.
 

Recent Policy Changes at the Nassau County Traffic and Parking Violations Agency

There recently have been a number of positive changes at the Nassau County Traffic and Parking Violations Agency. The policy at the Traffic and Parking Violations agency of refusing to reduce 8 and 11 point speeding tickets has been done away with. Even though I was always able to get the high speeding tickets reduced, I had to always schedule the case for trial, and then would obtain a reduction. Now I am able to get most 8 point speeds reduced to 3 point non speeding tickets. I have also been able to obtain substantial reductions on all the 11 point speeding tickets that I handle. Inasmuch as a conviction to an 11 point speeding ticket will result in an automatic suspension of your license, it is essential to get those speeding tickets reduced.
 
More good news – With regard to hand written tickets, there continues to be frequent failures to comply with my demand for supporting depositions, or in cases where the supporting deposition is provided, they are often defective. Consequently, I have been able to get many of these tickets dismissed after filing motions. It\'s important to note that in order to get a ticket dismissed at the Nassau County Traffic and Parking Violations Agency on these grounds; the demand for a supporting deposition must be made timely. Also a motion must be filed in writing within the strict time limits as interpreted by that court. The key to getting these tickets dismissed is to retain an attorney who is familiar with the nuances of the court, and have the demand filed as soon as possible, preferably prior to the first court date.

Recent Additions to the New York Vehicle and Traffic Law
 
Tickets for using a cell phone without a hands free device (VTL 1225-c) and tickets for using a portable device while driving (VTL 1225-d), have been raised to 5 points. They now carry more points than failing to yield, passing a red light or crossing hazard markings.
Another addition is a law that requires motorist to move over or slow down when passing stopped emergency vehicles on the side of the road ( VTL 1144-aa). This new section of law known as the move over law carries 2 points upon conviction.
